These Terms of Service ("Terms") set out the agreement between you and Pete Gawtry Fitness when you sign up for our online personal-training service. Please read them carefully — by starting a free trial or a paid subscription, you agree to be bound by them. If you don't agree, please don't sign up.
1. Definitions
- "We", "us", "our", "Pete Gawtry Fitness" — Peter Gawtry, trading as Pete Gawtry Fitness, a sole trader based at Unit 1, Tarn Lane, Leeds, LS17 9BF.
- "You", "the Member" — the individual who signs up for the Service.
- "Service" — the online personal-training subscription, including any meal-plan add-on, delivered through the website and the App.
- "App" — the Pete Gawtry Fitness App, a white-labelled version of My PT Hub, through which your programme is delivered.
- "Programme" — the training plan, and where applicable the meal plan, built for you and delivered through the App.
- "Subscription" — your ongoing paid membership to the Service.
- "Trial" — the 7-day free trial period that precedes your first payment.
- "Corporate Client" — an employer that buys the Service for its employees under a corporate package.
2. Who can use the Service
The Service is for adults only. You must be 18 or over to sign up. By registering you confirm that you are at least 18 and that the information you give us is accurate.
You must also be medically fit to take part in an exercise programme. Please read the medical disclaimer in section 10 and complete the PAR-Q (Physical Activity Readiness Questionnaire) honestly before you start training.
3. The Service we provide
Pete Gawtry Fitness provides a combination of:
- Digital content — training and meal plans, instructional material, and the App itself; and
- Personal-training services — your plan is personally built and signed off by Pete, with check-ins, messaging and ongoing adjustments.
Our promise is simple: built by Pete, not by AI. Tools may assist Pete, but every plan is personally reviewed and approved by him before it reaches you.
We aim to provide the Service with reasonable care and skill, as required by the Consumer Rights Act 2015. The Service is a coaching and guidance service — it is not a guarantee of any specific result. Outcomes depend on factors within your control, including how closely you follow your Programme.
4. Subscription tiers, pricing and billing
The current tiers are:
- Online PT — £79 per month.
- Meal Plan add-on — £30 per month, on top of Online PT.
- Corporate — from £15 per head per month, priced per agreement with the employer.
All prices are in pounds sterling (GBP). Pete Gawtry Fitness is not currently VAT-registered, so no VAT is charged on these prices. If our VAT status changes, we'll update these Terms and tell affected Members.
Subscriptions are billed monthly in advance. Your billing cycle runs from the day your first payment is taken (the day after your Trial ends) and renews on the same date each month.
Payments are processed by Stripe. We never see or store your full card details. By subscribing you authorise us, through Stripe, to take the recurring monthly payment from your chosen payment method until you cancel.
We may change our prices from time to time. If we change the price of your Subscription, we'll give you at least 30 days' notice by email before the new price applies, so you have time to cancel if you don't want to continue.
5. How your Subscription starts — the free trial
New Members start with a 7-day free trial. You provide your card details up front when you sign up, but you are not charged during the Trial.
If you do nothing, your Trial automatically converts to a paid Subscription on day 8, and your first monthly payment is taken then. To avoid being charged, you must cancel before the Trial ends (see section 8).
You may use the Trial once. We may decline or withdraw a Trial if we reasonably believe it's being abused (for example, repeated sign-ups to obtain free access).
6. Your right to cancel (14-day cooling-off)
Because you buy the Service online, you normally have a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, supported by your rights under the Consumer Rights Act 2015. This lets you cancel and get a refund of anything you've paid, for any reason, within 14 days of entering into the contract.
However, our Service is largely digital content and a service that you'll usually want to start using straight away. The law lets you do that, but only on these terms:
- When you sign up, you give your express consent for us to begin providing the Service (including the App and your Programme) immediately, during the 14-day cooling-off period; and
- You acknowledge that you will lose your right to cancel and get a full refund once the Service has been fully supplied, and that for any service we have already provided during the cooling-off period you may be charged a fair amount for what you've used.
You give this consent and acknowledgement by ticking the relevant box at sign-up. If you do not give that consent, we'll wait until the 14 days have passed before starting your Programme, and your full cancellation right is preserved during that time.
This is the standard "digital content / streaming-service" position (sometimes called the "Netflix exemption"): without your express consent and acknowledgement, the cancellation right survives in full. To cancel within the cooling-off period, just email pete@pg-fitness.co.uk — see the Refund Policy for how refunds are handled.
7. Automatic renewal
Your Subscription is a rolling monthly contract that renews automatically. Each month, on your billing date, Stripe takes your next monthly payment and your access continues, until you cancel.
We'll always be clear, before you subscribe, about the price, the billing frequency, the free-trial terms and how to cancel. You can cancel at any time (see section 8).
Upcoming law (DMCC Act 2024). The Digital Markets, Competition and Consumers Act 2024 introduces a new regime for subscription contracts, expected to apply from 2026/27. It will require things like clear pre-contract reminders, cooling-off windows at the start of a contract and around renewals, and a simple, no-friction way to cancel online. We've designed this Service with those requirements in mind, and we'll update these Terms to comply in full once the relevant rules are in force.
8. Cancelling and changing your Subscription
You can cancel at any time by emailing pete@pg-fitness.co.uk (and, where available, through your account settings). We'll confirm your cancellation.
- During the Trial: cancel before day 8 and you won't be charged.
- During the 14-day cooling-off period: see section 6 and the Refund Policy.
- After cooling-off: your cancellation takes effect at the end of your current billing period. You keep access until then, and you won't be billed again. We don't refund part-months for the current period — see the Refund Policy.
You can switch tiers (for example, add or remove the Meal Plan) by emailing us; changes take effect from your next billing date unless we agree otherwise.
9. Acceptable use
When you use the Service, you agree to:
- Give accurate health and personal information, and keep it up to date — your safety depends on it;
- Use the App and any materials for your own personal use only;
- Not share, copy, resell or redistribute your Programme, the App content, or any of our materials;
- Not share your login with anyone else;
- Treat Pete and any team members with respect in all messages and check-ins; and
- Not use the Service for anything unlawful.
All training plans, meal plans, written content and other materials we provide remain our intellectual property (or that of our licensors). You get a personal, non-transferable licence to use them while you're a Member. We may suspend or end your access if you seriously or repeatedly break these rules.
10. Medical disclaimer — please read
Pete Gawtry Fitness provides fitness coaching, not medical advice. Nothing in the Service — including training plans, meal plans, messages or any content in the App — is medical, nutritional-therapy, or healthcare advice, and it is not a substitute for advice from a qualified doctor or other healthcare professional.
- Before starting any exercise or nutrition programme, you should consult your doctor, especially if you have or suspect any medical condition, are pregnant, are recovering from injury or surgery, or are taking medication.
- You must complete the PAR-Q honestly before you begin training. If any answer suggests you should get medical clearance first, you agree to do so before starting your Programme.
- You take part in any exercise at your own risk. Stop immediately and seek medical help if you feel unwell, dizzy, faint, or experience pain or any concerning symptom.
- You are responsible for telling us about any change in your health that could affect your ability to exercise safely.
11. Limitation of liability
Nothing in these Terms limits or excludes our liability for anything that cannot be limited or excluded by law — in particular, liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any of your statutory rights as a consumer under the Consumer Rights Act 2015.
Subject to that:
- We provide the Service with reasonable care and skill, but we do not guarantee any specific fitness, weight, body-composition or health outcome;
- We are not liable for loss or damage that was not foreseeable, or that arises because you didn't follow your Programme, the medical disclaimer, or reasonable safety guidance;
- We are not liable for the acts, content or availability of third-party services we rely on (for example Stripe or the App platform), beyond our own responsibilities; and
- Our total liability to you for any claim connected with the Service is limited to the total amount you have paid us in the 12 months before the claim arose.
This section doesn't affect your consumer rights, including your right to remedies if the Service isn't carried out with reasonable care and skill.
12. Termination
You can end your Subscription as set out in section 8.
We may suspend or end your Subscription if you break these Terms (for example, the acceptable-use rules), if you fail to pay, or if we reasonably believe continuing would be unsafe for you. Where it's fair and practical to do so, we'll give you notice and a chance to put things right first. If we end your Subscription through no fault of yours, we'll refund any payment for a period you can no longer use.
On termination, your access to the App and your Programme ends. We handle your data after termination as set out in our Privacy Policy.
13. Corporate clients
If you access the Service through your employer's corporate package, these Terms still govern your individual use of the Service. The commercial terms (price, number of places, invoicing) are agreed separately with your employer, and a separate Data Processing Agreement governs how we handle employee data. Your individual training, check-ins and messages are never shared with your employer in identifiable form — see the Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time — for example to reflect changes in the law (such as the DMCC Act 2024 subscription rules) or in how the Service works. The "Last updated" date at the top shows the current version. If a change materially affects you, we'll tell you by email before it takes effect, and where the law requires it we'll give you the chance to cancel.
15. Governing law and disputes
These Terms, and any dispute arising from them or from the Service, are governed by the law of England and Wales, and are subject to the non-exclusive jurisdiction of the courts of England and Wales.
